BuzzD Timer Terms of Use

1. Who you are agreeing with
BuzzD Timer ("the App") is provided by Stupandas (ABN 94 696 024 046) ("we", "us", "our"), a registered business name operating as a sole trader in Australia.
You can contact us at support@stupandas.com.
By installing or using the App you agree to these Terms of Use ("Terms"). If you do not agree, do not install or use the App.
2. What the App is, and what it is not
BuzzD Timer is a countdown and alert utility. It displays timers and plays sounds or shows visual alerts at times you configure.
The App knows nothing about what you are timing. It has no knowledge of markets, medication, appointments, cooking, exams, or anything else. It does not connect to any external service, data feed, or platform of any kind. Everything it shows is derived solely from times you entered yourself, and it cannot tell whether what you entered is correct.
In particular, the App is not a medical device and must not be used for anything health-related: medication timing, treatment intervals, or any other clinical purpose. It is also not a trading tool, a financial product, or a source of financial advice: it does not connect to any broker, exchange, or market data feed, and has no knowledge of actual market hours, conditions, or prices.
You must not rely on the App for any purpose where a missed, late, early, or incorrect alert could cause loss, injury, or harm. That includes, without limitation, medication and medical appointments, financial or trading decisions, legal or regulatory deadlines, travel, examinations, and safety-critical timing of any kind.
Alerts can and will fail for reasons entirely outside our control, including but not limited to:
- your device being asleep, hibernating, powered off, or locked;
- system volume muted, the wrong audio device selected, or headphones unplugged;
- operating system notification settings, Focus Assist, or Do Not Disturb;
- your device's clock being wrong, or drifting, or changing time zone;
- time-zone or daylight-saving conversion producing a time you did not expect (see clause 2.1);
- the App being closed, crashed, or suspended by the operating system;
- other software taking priority over the App.
If the timing genuinely matters, for your health, your money, or anything else you cannot afford to miss, keep an independent means of tracking it. Treat the App as a convenience, never as your only reminder.
2.1. Time zones and daylight saving: no guarantee
The App lets you attach a time zone to an event and converts that time for display and for firing alerts. We do not warrant that these conversions are correct.
Conversion relies on the time-zone database supplied by your operating system and its web runtime. We do not control that database and cannot verify it. In particular:
- Time-zone rules change. Governments add, remove, shift, or abolish daylight saving, and sometimes change a zone's standard offset, occasionally at very short notice. If your device's time-zone data has not been updated to reflect a change, the App will convert using the old rules and show, and alert at, the wrong time.
- Daylight-saving transitions create ambiguous and non-existent local times. When clocks go forward, some local times never occur; when they go back, some occur twice. If an event falls in one of those windows the App must pick an interpretation, and it may not be the one you intended.
- Changing your device's time zone, or travelling, changes how times are displayed and when alerts fire.
- Your own entry may simply be wrong: the wrong zone selected, or a time entered in a zone other than the one you had in mind. The App cannot detect this.
You are responsible for verifying that your events fire at the times you actually intend, and for re-checking them after any daylight-saving transition, after travelling, and after any change to your device's time or region settings. Take particular care if an event's time zone is in a different country from you, because daylight saving starts and ends on different dates in different parts of the world (and not at all in some), so the gap between two zones is not constant through the year.
We are not liable for any loss arising from an incorrect time-zone or daylight-saving conversion. Subject to clause 8, this applies whether the cause is out-of-date time-zone data, a rule change, an ambiguous transition, or an error in the App itself.
3. Your licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own personal or internal business use.
You may not:
- sell, rent, lease, sublicense, or redistribute the App;
- remove or alter any copyright, branding, or attribution notices;
- attempt to circumvent the Pro entitlement checks or unlock paid features without paying for them.
Nothing in this clause limits any right you have under the Copyright Act 1968 (Cth), including your right to decompile for interoperability, or any other right that cannot lawfully be excluded.
We retain all intellectual property rights in the App. These Terms give you a licence to use it, not ownership of it.
4. Free and Pro tiers
The App has a free tier and a paid BuzzD Timer Pro tier.
Pro is a one-off purchase, not a subscription. There is no recurring charge and nothing to cancel.
Pro is sold through the Microsoft Store. That means:
- Microsoft is the merchant of record. We do not process, see, or store your payment details. Your purchase is also governed by Microsoft's own terms, including the Microsoft Store Standard Application License Terms and Microsoft's payment and refund policies, which apply in addition to these Terms.
- Refunds are handled by Microsoft, under Microsoft's refund policy and your rights under the Australian Consumer Law or your local equivalent. We generally cannot issue a refund directly, but contact us at support@stupandas.com if something has gone wrong and we will help where we can.
- Your entitlement is tied to the account you purchased with, not to a device.
How the entitlement check works: The App asks the Microsoft Store whether your account owns BuzzD Timer Pro each time it starts, and again straight after a purchase. If the Store cannot be reached, for any reason at all (being offline and a Store outage are only the common ones), the App continues to honour your last confirmed entitlement for 7 days. Only a Store that actually replies "not entitled" removes Pro access. In other words, we never treat silence as a "no".
If Pro access ends for any reason, the App disables features and content that exceed the free tier. It does not delete your events or settings.
Which features are Pro: The split between free and Pro features may change in future versions as the App develops. Our intention is that features you have paid for stay available to you, and we will not move a Pro feature behind a further payment. We may still have to change or withdraw a feature, because an operating system or the Microsoft Store removes something we depend on, for security or legal reasons, or because it can no longer be maintained. If we withdraw a significant part of what Pro offered, contact us and we will work out a fair outcome with you, and your rights under the Australian Consumer Law or your local equivalent are unaffected.
5. Donations
The App links to a PayPal donation page. Donations are:
- entirely voluntary: nothing in the App is gated behind them;
- not a purchase: they buy you no features, entitlements, support obligations, or rights of any kind;
- non-refundable, and handled entirely by PayPal under PayPal's own terms.
6. Your data is yours, and it stays on your device
The App stores your events, settings, and preferences locally on your device only. We do not operate a server, do not have accounts, and never receive a copy of your data. See the BuzzD Timer Privacy Policy for detail.
Your events survive an ordinary uninstall and reinstall, so upgrading to a new version does not cost you the events you have built up. Your preferences are stored in the same place and are normally kept too, but we do not promise that every setting will carry across every version.
Backups are still your responsibility. Your data can be lost if you tick "Delete app data" when uninstalling, clear the App's stored data, reset or lose your device, or if the device fails. The App provides an export function. Use it if your configuration matters to you, and to carry your setup to another computer. We cannot recover data we have never had.
7. Availability, updates, and changes
We may update, change, or discontinue the App or any of its features at any time. We are not obliged to provide updates, support, or continued availability, and the App may eventually stop working with future versions of Windows or other operating systems.
We may change these Terms. If we make a material change we will update the effective date above. The current version is always the one published on this page, which the App links to from its About panel. Continuing to use the App after a change means you accept the updated Terms.
8. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures you are entitled to a replacement or refund, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods or services remedied if they are not of acceptable quality and the failure does not amount to a major failure.
If you are outside Australia, you may have similar non-excludable rights under your local consumer law. Those rights are not affected by these Terms either.
9. Disclaimers and limitation of liability
Subject to clause 8, and to the fullest extent permitted by law:
- The App is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, reliability, or uninterrupted operation.
- We are not liable for any loss or damage of any kind arising from your use of, or inability to use, the App, including a missed appointment or dose, a missed deadline, a trading or financial loss, a missed opportunity, lost profit, lost data, or any indirect, incidental, special, or consequential loss. This applies to any alert that fails to fire, fires late, fires early, fires incorrectly, or fires at an unintended time because of a time-zone or daylight-saving conversion.
- Where our liability cannot be excluded but can be limited, our total liability to you is limited, at our option, to resupplying the App or refunding the amount you actually paid for it.
10. Termination
You may stop using the App at any time by uninstalling it.
We may suspend or terminate your licence if you materially breach these Terms, in particular if you attempt to circumvent the Pro entitlement checks. Termination does not affect any refund rights you have through the Microsoft Store or under consumer law.
11. Governing Law
These Terms are governed by the laws of the State of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria.
This does not deprive you of the protection of any mandatory consumer law of the country where you live.
12. Transfer
Stupandas currently operates as a sole trader. We may transfer these Terms, and our rights and obligations under them, to a successor entity that takes over the operation of Stupandas or of the App, including a company later formed for that purpose. We will note any such transfer in an updated version of these Terms.
A transfer does not reduce your rights: the successor takes on our obligations, your purchase and Pro entitlement are unaffected, and your rights under the Australian Consumer Law continue to apply. You may not transfer your licence or your rights under these Terms to anyone else without our written consent.
13. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
14. General
Our failure to enforce a provision is not a waiver of it. These Terms, together with the BuzzD Timer Privacy Policy and any applicable Microsoft Store terms, are the entire agreement between us about the App.
