Welcome to the Stupandas website ("Website"). These Website Terms of Use ("Terms") govern your access to and use of the Website operated by Stupandas ("Stupandas", "we", "our", or "us").

By accessing or using this Website, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use this Website.

The Website provides information about Stupandas, our software applications, products, services, support resources, downloads, news, and related content.

These Terms apply only to your use of this Website.

The use of any Stupandas software, including BuzzD Timer and any future applications, is governed by its own applicable Terms of Use, End User Licence Agreement (where applicable), and Privacy Policy.

You may use this Website only for lawful purposes and in accordance with these Terms.

You agree that you will not:

  • violate any applicable laws or regulations;
  • interfere with or disrupt the Website or its supporting infrastructure;
  • attempt to gain unauthorized access to any part of the Website or its systems;
  • introduce malware, viruses, or other harmful software;
  • use automated software, bots, crawlers, or scraping tools to collect Website content without our written permission, other than search engine crawlers that respect robots.txt, which are welcome;
  • use the Website to distribute unlawful, misleading, defamatory, abusive, or harmful material;
  • impersonate Stupandas or falsely suggest an affiliation with us; or
  • use this Website in a manner that may damage the reputation, security, or operation of Stupandas.

1.3. Intellectual Property

Unless otherwise stated, all intellectual property rights in this Website and its contents are owned by or licensed to Stupandas.

This includes, without limitation:

  • the Stupandas name;
  • the BuzzD Timer name;
  • the names, branding, logos, and visual identities of all current and future Stupandas software, products, and services;
  • all mascot characters, artwork, illustrations, animations, icons, graphics, designs, colour schemes, visual assets, user interface designs, screenshots, audio, video, documentation, downloads, source code (where applicable), and other creative works published by Stupandas;
  • all trademarks, copyrights, design rights, business names, domain names, trade dress, and other proprietary materials.

These materials are protected under applicable intellectual property laws in Australia and other jurisdictions.

You may access and download Website content solely for your personal, non-commercial use.

Except where permitted by law or with our prior written consent, you must not:

  • copy, reproduce, publish, distribute, modify, adapt, translate, or commercially exploit Website content;
  • remove copyright, trademark, or proprietary notices;
  • use any Stupandas branding in a way that suggests endorsement or affiliation;
  • use our artwork, branding, mascots, or creative works to train, fine-tune, evaluate, or develop artificial intelligence or machine learning systems;

All rights not expressly granted are reserved by Stupandas.

1.4. Character Rights and Brand Identity

The Stupandas mascot characters, including the red panda, the panda bear, and any current or future mascot characters developed by Stupandas, are distinctive elements of the Stupandas brand.

These characters include their names, visual appearance, proportions, colour palettes, personalities, expressions, poses, accessories, animations, stories, artwork, and other identifying characteristics.

These character identities are protected as part of the Stupandas intellectual property portfolio.

Without our prior written permission, you must not:

  • reproduce or commercially exploit the characters or substantially similar versions of them;
  • create derivative characters intended to imitate or compete with the Stupandas brand;
  • use the characters on products, websites, software, games, merchandise, advertising, NFTs, digital collectibles, or other commercial material;
  • falsely imply endorsement or affiliation with Stupandas; or
  • use the characters in a way that damages, dilutes, or misrepresents the Stupandas brand.

Nothing in these Terms prevents lawful commentary, criticism, reporting, review, parody, or other uses permitted by applicable law.

1.5. Software Downloads

Software made available through this Website may be subject to separate licence agreements or Terms of Use.

Downloading software from this Website grants you a licence to use that software only as permitted by the applicable licence.

Ownership of the software and all associated intellectual property remains with Stupandas or its licensors.

1.6. Third-Party Services

This Website may contain links to third-party websites or services, and may embed content that a third party serves directly to your browser, including application stores, payment providers, documentation, or external resources.

Embedded content is requested by your browser from the third party when a page loads, rather than only when you click something. Section 2.5 of the Privacy Policy below describes what this means for your information.

These services operate independently from Stupandas.

We do not control, endorse, or accept responsibility for their content, availability, privacy practices, security, or terms.

Your use of third-party services is subject to their own policies and agreements.

1.7. Donations

The Website may allow users to make voluntary donations to support the continued development of Stupandas software.

Unless expressly stated otherwise:

  • donations are entirely voluntary;
  • donations do not purchase ownership, shares, equity, or intellectual property rights;
  • donations do not guarantee future features, updates, support, or development priorities;
  • donations do not provide premium functionality unless expressly advertised; and
  • donations are generally non-refundable except where required by applicable law.

Payments may be processed by third-party providers whose own terms and privacy policies apply.

Website Privacy Policy

2. Stupandas Website Privacy Policy

This Privacy Policy forms part of the Terms of Use above and applies to visitors to the stupandas.com website. Our applications each have their own privacy policy, which covers that application and is available from within it and from this website. This policy does not describe any of our applications.

2.1. Who we are

This website is operated by Stupandas (ABN 94 696 024 046), a registered business name operating as a sole trader in Australia. You can contact us at support@stupandas.com.

2.2. Information you give us

The only way to contact us through this website is by email. If you email us, we receive your email address and whatever you choose to put in your message. We use it to answer you, and we keep it only as long as needed for that purpose. We do not add you to a mailing list and we do not send marketing.

2.3. Information collected automatically

This website is hosted on Cloudflare Pages. Cloudflare automatically records standard technical information when you visit, including your IP address, browser type, device type, the pages you viewed, and the time of your visit. This is generated by the hosting platform, not by us.

Cloudflare also adds a small analytics script to our pages, Cloudflare Web Analytics, which reports page views and basic performance information. It sets no cookies and does not follow you to other websites. What it gives us is counts rather than people: roughly how many visitors the site gets and which pages they read.

We do not use any of this to identify you personally, and we do not attempt to build a profile of you. Cloudflare's own handling of it is covered by the Cloudflare Privacy Policy at cloudflare.com/privacypolicy.

2.4. Analytics and cookies

This website does not set cookies, and does not use analytics cookies, advertising cookies, or any cookie that tracks you across other websites. The analytics described in section 2.3 work without cookies.

The Microsoft Store badge described in section 2.5 is served by Microsoft from Microsoft's own domain. We set no cookies through it and receive nothing back from it, but what Microsoft serves is under Microsoft's control rather than ours, and is covered by Microsoft's privacy statement rather than by this policy.

2.5. Other companies' services on this website

The Microsoft Store badge, whether or not you click it. Where we point you to one of our apps in the Microsoft Store, we show Microsoft's own Store badge rather than a plain link: the button that takes you to that app's listing. You will find it on our homepage and on the page for each app we sell there. The badge is not an image we host. Your browser fetches it from Microsoft (get.microsoft.com) when the page opens, along with a small script and a hidden frame that Microsoft uses to make the button work. That happens as the page loads, before you touch anything, and it happens even if you never click the badge.

As a result, Microsoft receives what any website receives when a browser asks it for something: your IP address, your browser and device details, and the fact that the request came from stupandas.com. We do not send any of this to Microsoft, we never see it, and Microsoft tells us nothing about you in return. It is your browser talking to Microsoft directly. If you do click the badge, you are taken to the Store listing, and Microsoft is also told that you arrived from our website.

What Microsoft does with that information is covered by the Microsoft Privacy Statement at privacy.microsoft.com/privacystatement. If you would rather your browser did not contact Microsoft, a content blocker or script blocker will stop it, and the page still works: the badge falls back to a plain link, which contacts nobody until you click it.

The Microsoft Store, where our applications are distributed. Purchases are handled by Microsoft under Microsoft's own privacy statement.

PayPal, only if you choose to donate. Nothing is sent to PayPal unless you click the donation link. Any payment is handled entirely by PayPal under its own privacy policy, we never see your payment details.

Once you follow a link to another service, that service's privacy policy applies, not this one. We are not responsible for how other companies handle your information.

2.6. We do not sell your information

We do not sell, rent, or trade information about visitors to anyone. We do not share it except where we are required to by law.

2.7. Your rights

You can ask us what personal information we hold about you, ask us to correct it, or ask us to delete it. Email support@stupandas.com and we will respond within 30 days. In practice we hold very little, generally only past email correspondence. If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au. If you are in the EU, UK, or another region with a data protection authority, you may also complain to your local regulator.

2.8. Children

This website is not directed at children and we do not knowingly collect information from them.

2.9. Changes

If we change this policy we will update the effective date above.
